Haiti: A blind revoked in search of justice


After 15 years at the National Television of Haiti, Peterson Célius Orelma, a blind, was revoked by Director Pradel Henriquez. Mr. Samuel Madistin, the victim's lawyer said the case was heard by the Superior Court of Audit since May 20, 2008 and to date no decision has been taken. Peterson Célius Orelma, used the position of receptionist at the National Television of Haiti since 1992, was revoked in 2007 by Director Pradel Henriquez because he is blind, and that this post is reserved for women, according to Mr. Samuel Madistin.

The lawyer said that after his office was contacted by Peterson, he is confronted by a ciyoyen who needed to be assisted, while being aware that the Superior Court of Auditors and Administrative Disputes (CSC / CA) is afraid to litigants and lawyers discouraged by putting too much time for making a decision and its execution.

However, with perseverance and lots of fighting, the case was heard before the Court and heard by Judge Joseph Paul Yves May 20, 2008. But after 19 months, no decision has been taken.

In the opinion of Mr. Madistin, three months is the maximum period sufficient for the Court to make and enforce decisions.

For his part, Peterson said Orelma be disappointed that the Court refuses to take a decision after all this time that the case was heard. He continues: "if the Director Pradel Henriquez was a misjudgment and discriminatory on my person, then the former President of the Court drove the knife in the wound, completely ignoring my rights as a litigant."

So says he: "I hope that the current President of the Court, Mrs. Nonie Mathieu, differs from its peers and it is working to change the image of the Court before it ceases to be the descent into hell for dismissed employees. "

From his side Mr. Samuel Madistin hoped that judicial reform advocated by the Department of Justice will also affect the Superior Court of Auditors.
